Agreement on the processing of personal data

1. General provisions

• 1.1. These Rules are an official document of the Radioham resource,and determine the procedure for processing and protecting information about individuals using the services of the website https://radioham.ru/ (hereinafter referred to as the Site) and its Users.
• 1.2. The purpose of these Rules is the user's consent to ensure the protection of information, including their personal data, from unauthorized access and disclosure.
• 1.3. Relations related to the collection, storage, dissemination and protection of information about Site users are regulated by these Rules, other official documents of the Site Administration and the current legislation of the Russian Federation, including on the basis of Federal Law No. 152 FZ" On Personal Data " of 27.07.2006..
• 1.4. The current version of the Rules, which are a public document, is available to any Internet user when clicking on the link https://radioham.ru/personal.html. The Site Administration has the right to make changes to these Rules.

Changes to the terms of these terms and conditions come into force from the moment of publication (updating) of this agreement on the site. We recommend that you regularly check these rules for changes.

• 1.5. These Terms are developed and used in accordance with the Site's Terms of Use Radioham.ruRadioham.ru posted on the Site at https://radioham.ru/rules.html. In case of contradictions between these Rules and other official documents of the Site Administration, these Rules are subject to application.
• 1.6.By registering and using the Site, the User agrees to the terms of these Terms and Conditions.
• 1.7.If the User does not agree with the terms of these Terms, the use of the Site and its services must be immediately terminated.
• 1.8. If, in accordance with the law, it is required to obtain a separate User's consent to the processing of personal data in connection with the use of the Site, then such consent is requested from the User only in relation to the use of the Site.

2. Terms of Use of the Site

• 2.1. By providing services related to the use of the Site and its services (hereinafter referred to as the Site Services), the Site Administration, acting reasonably and in good faith, believes that the User:
• has all the necessary rights that allow it to register and use this Site;
• indicates reliable information about yourself to the extent necessary to use the Site's Services.
• understands that information posted by the User about himself on the Site may become available to other Users of the Site and Internet users, may be copied and distributed by such users;
• understands that certain types of information that they have shared with other Users cannot be deleted by the User.
• is familiar with these Rules, expresses its consent to them and assumes the rights and obligations specified in them.
• 2.2.The Site Administration does not verify the accuracy of the received (collected) information about users, except in cases when such verification is necessary in order for the Site Administration to fulfill its obligations to the user.

3. Purposes of information processing

The Site Administration processes information about Users, including their personal data, in order to fulfill the Site Administration's obligations to Users regarding the use of the Site and its services.

4. Composition of user information

• 4.1. Personal data of Users
  Personal data of Users includes:
• 4.1.1. provided by Users and minimally required for registration on the Site: first name, last name, patronymic, gender, date of birth, mobile phone number, email address;
• 4.1.2. provided by Users using the editing section of the personal profile page on the Site (including the User's photo, date of birth, hometown, home address, information, occupation, identification signal, and other data);
• 4.1.3. additionally provided by Users at the request of the Site Administration in order for the Site Administration to fulfill its obligations to Users arising from the Site Service Agreement. The Site Administration has the right, in particular, to request from the User a copy of an identity document or other document containing the User's name, surname, photo, as well as other additional information that, at the discretion of the Site Administration, will be necessary and sufficient to identify such a User and will allow to exclude third-party abuse and / or violations rights of third parties.

• 4.2. Other User Information processed
  by the Site Administration The Site Administration may also process other User information, which includes:
• 4.2.1.additional data obtained when accessing the Site, including data on technical means (devices), technological interaction with the Site (including the IP address of the host, the type of user's operating system, browser type, geographical location, Internet service provider, data from the address book, data obtained as a result of access to the camera, microphone, etc. devices), and subsequent User actions on the Site. Information containing the User's Site visit history is available to the User in the "Settings / Security" section.
• 4.2.2.information automatically obtained when accessing the Site using bookmarks (cookies);
• 4.2.3. information created by users on the Site outside of the page editing section (including statuses, microblog entries ("Wall"), comments, group discussion entries);
• 4.2.4. information obtained as a result of User actions on the Site (in particular, information about joining / leaving the group, adding other Users to the friends list, posting photos. This information about the User can be available to all users and site visitors in the "Feed" section in accordance with the user's settings.
• 4.2.5. information obtained as a result of actions of other users on the Site.
• 4.2.6. When the User uses the Site's functionality.

5. Processing user information

• 5.1. Personal data is processed on the basis of the following principles:
  a) the legality of the purposes and methods of processing personal data;
  b) good faith;
  c) compliance of the purposes of processing personal data with the goals defined in advance and declared during the collection of personal data, as well as with the powers of the Site Administration;
  d) compliance of the volume and nature of the processed personal data, methods of processing personal data with the purposes of processing personal data;
  e) inadmissibility combining databases containing personal data created for incompatible purposes.
• 5.1.1.Terms and purposes of personal data processing
  The Site Administration processes the User's personal data in order to fulfill the contract between the Site Administration and the User for the provision of Site Services. By virtue of Article 6 of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data", the user's separate consent to the processing of his / her personal data is not required.

  Collection of personal data The User's personal data is collected on the Site during registration, as well as in the future when the user enters additional information about himself / herself on his / her own initiative using the Site's tools.
  Personal data specified in clause 4.1.1. of these Terms are provided by the User and are minimally necessary during registration.
  The personal data provided for in clause 4.1.2. of these Terms are additionally provided by the User on their own initiative using the "Profile Editing" functionality in the "User Profile" section of the site.
• 5.1.3.Storage and use
  of personal data Users ' personal data is stored exclusively on electronic media and processed using automated systems, except for cases when non-automated processing of personal data is necessary in connection with compliance with legal requirements.
• 5.1.4. Transfer
  of personal data Users ' personal data is not transferred to any other third parties, except in cases expressly provided for in these Terms.
  At the User's request or with the User's consent, it is possible to transfer the User's personal data to third parties-contractors of the Site Administration, provided that such contractors assume obligations to ensure the confidentiality of the information received.
  The provision of personal data of Users at the request of state bodies (local self-government bodies) is carried out in accordance with the procedure provided for by law. In order to fulfill the agreement between the User and the Site Administration and provide the User with access to the use of the Site functionality, the Site Administration develops the provided services and products, develops and implements new services and products, optimizes the quality of services and products, improves the available functionality of the Site and services. To ensure the implementation of these goals, the User agrees to the implementation of the Site Administration in compliance with the applicable legislation of service mailings to his address (including surveys) in order to receive feedback through the services of the Site Administration and/or third-party services: electronic messages, SMS and other types of mailings, as well as collection, storage, accumulation, systematization, extraction, comparison, use, filling (refinement) of their data, as well as receiving and transmitting to affiliates and partners the results of automated processing of such data using various models for evaluating information in the form of integer and / or text values and identifiers corresponding to the evaluation criteria specified in requests, for data processing by the Site Administration and/or the persons specified in this clause.
  The User instructs the Management of the Radioham Website to process thedatacollected by the Site about the User, to the extent specified in these Terms, including their processing together with the User data available toRadioham, to the extent specified in the privacy policy(s) of the Radioham service(s),which(m) is used by the User in order to improve the quality of the services provided by the Site, namely: to satisfy the User's interests by displaying information relevant to the User's interests, targeting accurate advertising (displaying information relevant to their interests), and generating generalized statistical/ analytical information. Registration and / or authorization on the Radioham Websiteusingthe API tool means that you agree to the User Agreement of the Site Rules and the Rules for Processing Personal Data.
  In order to use and provide the services and/or grant rights and opportunities to use the Services and tools, the User hereby agrees and instructs the Site Administration to transfer and receive personal data and other information about the User to the Radioham Services and Toolsforsubsequent collection, storage, accumulation, systematization, extraction, comparison, use, filling of such data Services/tools to the required extent.
  In order to display relevant ads for Users and for the purposes of adapting and improving ads, as well as restrictions in connection with violations of current legislation, the technical capability of the Radioham websiteusesthe IP address of the User's device and the identifier, taking into account the requirements of the current legislation of the Russian Federation.
• 5.1.5.Destruction
  of personal data The User's personal data is destroyed if:
  - the User independently deletes data from their personal page;
  - the Site Administration deletes information posted by the User, as well as the User's personal page in cases established by the Site's Terms of Use.
  In case of deletion of a personal page, the Site Administration stores the User's personal and other necessary data on its electronic media for the period required and established by the current legislation of the Russian Federation.
  In case of self-deletion of their personal page, the User has the right to restore their personal page in the settings.
• 5.2. By posting information on the personal page, including their personal data, the User understands and agrees that this information may be available to other Internet users, taking into account the features of the Site's architecture and functionality. The User independently determines the privacy policy and conditions of access to the information specified in clauses4.2.3-4.2.5 of these Rules, using the appropriate settings. The Site administration takes technical and organizational measures to ensure such opportunities.

6. Rights and obligations of users

• 6.1. Users are entitled to:
• 6.1.1. freely access information about yourself by uploading your personal pages on the Site using your username and password;
• 6.1.2.using the Site's tools, set the desired level of confidentiality (terms of access to information) in relation to your personal information in accordance with clause 6.3 of these Rules;
• 6.1.3.independently make changes and corrections to the information about yourself on the User's personal page on the Site, provided that such changes and corrections contain up-to-date and reliable information;
• 6.1.4.delete information about yourself from your personal page on the Site;
• 6.1.5. require the Site Administration to clarify their personal data, block or destroy them if such data is incomplete, outdated, unreliable, illegally obtained or not necessary for the stated purpose of processing and if it is impossible to independently perform the actions provided for in paragraphs6.1.3. and 6.1.4. of these Rules;
• 6.1.6.on the basis of a request to receive information from the Site Administration regarding the processing of their personal data.
• 6.2. Since the Site is a universal means of communication and search for people and the main function of the Site is to restore and maintain connections, the following information about the registered User is always available to any registered User of the Site:
• 6.2.1. The User's First and Last name and Patronymic;
• 6.2.2. Date of Birth, profile photo, city, information, occupation, User's microblog entries ("Wall"), if the User posted this information on the Site in the "My Page" section;
• 6.2.3.information about the user's subscriptions and subscribers;
• 6.2.4. list of the user's friends, except if the user chose to hide them.
• 6.3.Setting the user's personal information privacy level
• 6.3.1. The User has the right, subject to the restrictions provided for in clause 6.2. of these Rules, to set flexible privacy settings in their personal profile;
• 6.3.2.The Site Administration is not responsible for the disclosure of the User's personal data by other Site Users who have obtained access to such data in accordance with the User's chosen level of confidentiality.
• 6.3.3. When deleting personal data (other user information) from the User's personal page or deleting the User's personal page from the Site, information about the User copied by other Users or stored on the pages of other Users is saved.
• 6.4. The User independently determines the terms and conditions and grants access to their personal data to an unlimited number of persons, including by registering and using the standard functionality, as well as by using the privacy settings and visibility of their personal page within the functionality provided to the User in accordance with clause 6.3 of these Rules. The Site Administration does not initiate or influence such a User's choice, nor does it have the goal of obtaining permission from the User to distribute their personal data. Processing of personal data made available by the User to an unlimited number of persons is carried out by the Site Administration on the basis and in accordance with the terms of the Terms of Useof the Radioham siteand these Terms.

7. Measures to protect User information

• 7.1.The Site Administration takes technical and organizational and legal measures to ensure the protection of the User's personal data from unauthorized or accidental access to them, destruction, modification, blocking, copying, distribution, as well as from other illegal actions.
• 7.2.The User's login (email address) and password are used to authorize access to the Site. The User is responsible for the security of this information. The user must have a complex password. The user does not have the right to transfer data for authorization on the site (his own username and password to third parties), and is also obliged to take measures to ensure their reliability and confidentiality.
• 7.3. In order to ensure more reliable protection of User information, the Site Administration uses a two-factor authentication system.
  As part of the page linking system, if the User loses their username or password, they can restore access to the page using a recovery code, which the User can request to the email address specified during registration on the site.
• 7.4. The User has the right to receive information about what time and from what devices authorization was performed on his personal page in the "Edit profile" section / Sessions". View sessions with active access from a PC or mobile app and end any of the sessions if necessary.

8. Limiting the validity of Rules

• 8.1.These Rules do not apply to the actions and Internet resources of third parties.
• 8.2.The Site Administration is not responsible for the actions of third parties who, as a result of using the Internet or the Site's Services, have obtained access to information about the User in accordance with the User's chosen level of confidentiality, for the consequences of using information that, due to the nature of the Site, is available to any Internet user. The Site administration recommends that Users take a responsible approach to solving the issue of the amount of information about themselves posted on the Site.

9. User requests

• 9.1. Users have the right to send their requests to the Site Administration, including requests regarding the use of their personal data provided for in clause 6.1.6 of these Rules, through the feedback form on the site.
• 9.2.The request sent by the user must contain the following information:
• number of the main identity document of the user or their representative.
• information about the date of issue of the specified document and the issuing authority;
• information confirming the user's participation in relations with the operator (in particular, the user id sequence number or a short (subdomain) name that replaces the id sequence number).
• signature of the user or their representative.
• 9.3.The Site Administration undertakes to review and send a response to the user's request received within 30 days from the date of receipt of the request.
• 9.4. All requests received by the Site Administration from users (written or electronic requests) relate to restricted access information and are not disclosed without the User's written consent. Personal data and other information about the User who sent the request may not be used without the User's special consent, except for responding to the subject of the request received or in cases expressly provided for by law.
